Limited Liabilities (computers, parts and components). ACS , here expressly disclaims any liability and shall not be held responsible in relation to our products or services for incidental, consequential, or contingent damages of any kind, including but without limitation: damages to persons or property, whether a claim for such damages is based upon our warranty, contract or otherwise; damages due to or arising out of the loss of data; or lost profits. ACS maximum liability allowed is limited to only the purchase price of the products sold. ACS shall not be held responsible wheather express or implied and under no circumstances shall be liable upon a claim relating to the products it sells which exceeds this liability limit.

Payment Policy . Online purchases of computers, parts, components or accessories must be paid in full prior to shipping. Service calls are expected to be paid in full at the time services are rendered, unless prior arrangements have been made. Web services such as web design, web hosting, web maintenance and marketing are to be paid at time services are ordered.

Web Hosting. Customer shall not post, transmit, re-transmit or store material on or through any of Services which, in the sole discretion of ACS is in violation of any local, state, or federal law or regulation: threatening, obscene, indecent, defamatory or that otherwise could adversely affect any individual, group or entity or violates the rights of any person, including the rights protected by copyright, trade secret, patent or other intellectual property or similar laws and or regulations. Customer shall be responsible for determining what laws or regulations are applicable to its use of our Services.

Misuse of System Resources. It is a violation for anyone to post information or to include programs on our hosting services which consume excessive bandwidth or CPU time. Background processes, including, but not limited to: ircbot, bnc, proxy, email sender, daemons, are strictly prohibited.

Email Policy. We have a zero tolerance policy on SPAM, Junk E-mail or UCE. Spam, Junk-mail, UCE are defined as: the sending of the same, or substantially similar, unsolicited electronic mail messages, whether commercial or not, to more than one recipient. A message is considered to
be unsolicited if it is posted in violation of a newsgroup charter or if it is sent to a recipient who
has not requested or invited the message. This also includes forged headers, compromised mail server relays, and false contact information. This violation extends to the sending of unsolicited mass mailings from another service, which in any way implicates the use of ACS services whether or not the message actually originated from our network.

Any violation of this provision are grounds for immediate suspension of the hosting account that is involved, ACS does not issue credits or refunds for un-used pre-paid hosting services if it is found that the offending account has violated the terms of service.

Services Refund Policy. ACS offers non-tangible irrevocable goods and services, we do not issue refunds once an order is placed and work has been authorized by the client. All sales are final and we are unable to provide a refund. We verify orders by phone prior to billing. Once client has been billed and payment has been made. The client autherizes this work order, and agrees to this policy .

Web Services Agreement. Client agrees to provide all images, content, information, that may be required to complete website design, search engine optimizing, maintenance and marketing. ACS may request images and or content and it is the clients sole responsability to provide the requested files by postal mail or by email. Failure of client to provide files and or information may cause a delay in services and or cancelation of the clients project.

Web Services Liability. The client’s project, is available on an “AS IS” basis. And we make no warranty of any kind, whether expressed or implied, to the fitness of any service or product for
a particular purpose including, without limitation, the projects, web design, marketing, website maintenance, technical malfunction, loss of data, unauthorized use or access to any website or records, or other injury, damage or disruption to client.
